Your privacy is important to us. This Privacy Policy document explains the collection, use and disclosure of information that we receive through Hex. This Privacy Policy does not apply to any third-party websites, services, or applications, even if they are accessible through our Services.

This policy describes how Hex Technologies Inc. ("we," "us," or "Company") collects, aggregates, stores, safeguards, and uses the data and information (including non-public personal information, or "NPI") provided by users through our website, hex.tech (the "Site"), as well as information collected by us through other means, including by email, over the phone, or in offline communications. This Site is operated by the Company and has been created to provide information about our company, products, and services (together, the "Services"). This policy applies to the Site, the Services, our mobile, tablet, and other smart device applications, application program interfaces, and chat window or chatbots (collectively, "Application"). The Site, Application, and Services together are hereinafter collectively referred to as the "Site."

This policy explains:

This policy is incorporated into and a material term of your registration and/or use of Company's products and services, including our website, hex.tech. By using the Site, you consent to the practices set forth in this Privacy Policy. In this policy, "personal information" and "personal data" are used interchangeably and have the same meaning. This Privacy Policy does not apply to information that we process as a data processor on behalf of our customers while providing services to them. Our use of information that we process on behalf of our business customers is governed by our agreements with such customers. If you have concerns regarding your personal information that we process on behalf of our customer, please direct your concerns to the customer with whom you have a relationship.

Additionally, this Privacy Policy does not apply to our employees, independent contractors, or job candidates.

INFORMATION WE COLLECT

Information You Provide to Us

Company collects information from you when you choose to provide it to us through the Site or through any other means. This may include when you create an account on the Site, register or request products or services, request information from us, sign up for newsletters or our email lists, use our Site, interact with our chatbots, or otherwise contact us.

The information we collect may include your name, address, email address, telephone or mobile phone number, and information from other third-party applications you connect to the Site. You may be required to provide certain personal and/or business information to apply for and receive Company products or services.

Information We Automatically Collect

We may use cookies or other technologies to automatically collect certain information when you visit our Site or interact with our emails. For example, if you are responding to an offer, promotional email, or other email from us, we may automatically populate your personal information into our system once you enter your offer code or similar identifying device or otherwise accept your offer or promotion. Additionally, we may automatically collect certain non-personal information from you such as your browser type, operating system, software version, and Internet Protocol ("IP") address. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them. We currently do not take action in response to these signals.

HOW WE USE INFORMATION WE COLLECT

Company uses the data and information you provide in a manner that is consistent with this Privacy Policy and applicable law. If you provide personal data for a certain reason, we may use the personal data in connection with the reason for which it was provided. For instance, if you contact us by email, we will use the personal data you provide to answer your question or resolve your problem. Also, if you provide personal data in order to obtain access to the Site, we will use your personal data to provide you with access to the Site and to monitor your use of the Site.

Company may also use your personal data and other personally non-identifiable information collected through the Site or the provision of the Services to help us improve the content and functionality of the Site or the Services, to better understand our users, and to improve the Site and the Services. Company and its affiliates may use this information to contact you in the future to tell you about services we believe will be of interest to you. As part of these activities, we may create aggregated, de-identified, or other anonymous data from personal information. We may use this anonymous or de-identified data and share it with third parties for any lawful business purposes. We do not attempt to reidentify de-identified information derived from personal information, except for the purpose of testing whether our de-identification processes comply with applicable law. OUR RETENTION OF YOUR PERSONAL DATA

Company will retain personal data we collect from you for so long as we have an ongoing legitimate business need to do so. We determine the appropriate retention period for personal data on the basis of the purpose for which we process the personal data, the amount, nature, and sensitivity of your personal data processed, the potential risk of harm from unauthorized use or disclosure of your personal data, and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation). When we have no ongoing legitimate business need to process your personal data, we will either delete or anonymize it or, if this is not possible (for example, because your personal data has been stored in backup archives), then we will securely store your personal data and isolate it from any further processing until deletion is possible. Company may also retain your personal data during the period needed for us to pursue our legitimate business interests, conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements.

SHARING OF INFORMATION WE COLLECT

Company is not in the business of selling your information. There are, however, certain circumstances in which we may share your personal data with certain third parties without further notice to you, as set forth below:

Agents, Consultants, and Third Party Service Providers:

Company, like many businesses, sometimes hires other companies to perform certain business-related functions. Examples of such functions include mailing information, maintaining databases, and processing payments. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function.

Business Transfers:

As we develop our business, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, dissolution, or similar event, personal data may be part of the transferred assets.

Related Companies:

We may also share your personal data with our corporate affiliates and subsidiaries, if any, for purposes consistent with this Privacy Policy.

Legal Requirements:

Company may disclose your personal data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend the rights or property of Company, (iii) act in urgent circumstances to protect the personal safety of users of the Site, the Services, or the public, or (iv) protect against legal liability.

The Site may have links to third-party websites, which may have privacy policies that differ from our own. We are not responsible for the practices of such sites, nor does any such link imply that Company endorses or has reviewed the third-party site subject to such link. CHILDREN AND MINORS

Company does not knowingly collect personal data from minors under the age of 18. If you are under the age of 18, please do not submit any personal data through the Site. We encourage parents and legal guardians to monitor their children's Internet usage and to help enforce our Privacy Policy by instructing their children never to provide personal data without the parent's permission. If you have reason to believe that a minor under the age of 18 has provided personal data to Company through the Site, please contact us, and we will endeavor to delete that information from our databases.

DATA SECURITY

We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Site visitors. While we make reasonable efforts to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures. ARTIFICIAL INTELLIGENCE AND LARGE LANGUAGE MODELS

Hex does not collect, use, or sell personal information gathered through this Site for the purpose of training large language models or other artificial intelligence models. For information about how Hex handles data within the Hex product and AI-powered features, please refer to the applicable Hex terms and conditions.

ACCESS TO YOUR PERSONAL INFORMATION

To keep your personal data accurate, current, and complete, please contact us as specified below. We will take reasonable steps to update or correct personal information in our possession that you have previously submitted via the Site.

INFORMATION FOR U.S. STATE RESIDENTS

Depending on the U.S. state in which you reside, you may have one or more of the following rights with respect to the personal information we collect about you through the Site:

  • Right to Know / Access. You may request that we disclose the categories or specific pieces of personal information we have collected about you.

  • Right to Delete. You may request that we delete the personal information we have collected about you, subject to certain exceptions.

  • Right to Correct. You may request that we correct inaccurate personal information we maintain about you.

  • Right to Opt Out. You may opt out of the sale or sharing of your personal information, or the processing of your personal information for targeted advertising using the Site. Hex does not sell personal information.

These rights are available to residents of states with applicable comprehensive privacy laws, including but not limited to California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia. Automated Decision-Making. We do not use your personal information to engage in automated processing or profiling personal information to evaluate, analyze, or predict personal aspects related to your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements to make a decision that produces legal or similarly significant effects.

Sensitive Personal Information. While certain of the personal information we collect may qualify as sensitive personal information under U.S. State Privacy Laws (e.g., account log-in information or payment data), we do not use or share such information in a manner that is subject to an opt-out right.

Consumers Under 18. We do not have actual knowledge that we have collected, sold, or shared the personal information of residents who are under 18 years of age.

Additional Information for Nevada Residents. While we do not currently sell personal information as defined under Nevada law, if you are a Nevada resident and would like to make a request to opt out of any potential future sales, please email [email protected].

INFORMATION FOR EEA, UK, AND SWISS USERS

If you live outside of the United States, you understand and agree that we may transfer your information to the United States. This site is subject to U.S. laws, which may not afford the same level of protection of those in your country. If you do not want your information transferred to the United States, do not use the Site.

What Rights Do I Have?

Controller. Hex Technologies Inc. is the controller in respect of the processing of your personal information covered by this Privacy Policy for purposes of European data protection legislation.

Residents of the European Economic Area (EEA), UK, and Switzerland have certain rights in respect of your personal information. You may ask us to take the following actions in relation to your personal information that we hold:

  • Contractual Necessity: where we need to perform a contract we are about to enter into or have entered into with you.

Please note, you will continue to receive essential account-related information, even if you unsubscribe from promotional emails.

PARTICIPATION IN THE EU-U.S. DATA PRIVACY FRAMEWORK (EU-U.S. DPF), THE UK EXTENSION TO THE EU-U.S. DPF, AND THE SWISS-U.S. DATA PRIVACY FRAMEWORK (SWISS-U.S. DPF)

Company participates in the EU-U.S. Data Privacy Framework ("EU-U.S. DPF"), the UK Extension to the EU-U.S. DPF ("UK Extension"), and the Swiss-U.S. Data Privacy Framework ("Swiss-U.S. DPF") (collectively, the "DPF") administered by the U.S. Department of Commerce. Company commits to comply with the DPF Principles with respect to Personal Data Company receives from the EU, United Kingdom, and Switzerland in reliance on the DPF. If there is any conflict between the terms in this Policy and the DPF Principles, the DPF Principles will govern. Company is responsible for the processing of personal data it receives under the DPF, and subsequently transfers to a third party acting as an agent on its behalf and for all onward transfers of personal data from the EU, United Kingdom, and Switzerland, including the onward transfer liability provisions.

In compliance with the DPF, Company commits to resolve complaints about our collection or use of your personal information. EU, Swiss, and/or UK individuals with inquiries or complaints regarding our Privacy Policy should first contact us at: [email protected].

Company has further committed to cooperate with and comply respectively with the advice of the panel established by the EU data protection authorities (DPAs), the UK Information Commissioner's Office (ICO), the Gibraltar Regulatory Authority (GRA), and the Swiss Federal Data Protection and Information Commissioner (FDPIC) with regard to unresolved complaints concerning our handling of personal data received in reliance on the DPF.

Finally, as a last resort and under limited circumstances, if your DPF complaint cannot be resolved through the above channels, EU, UK and Swiss individuals may invoke binding arbitration for some residual claims not resolved by other redress mechanisms. The Federal Trade Commission has jurisdiction over Company's compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF).

YOUR CHOICES/PREFERENCES

Marketing Communications. You can opt out/unsubscribe from our promotional emails via the link provided in the emails we send you or by sending an email to [email protected]. Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us if you are a user of the Hex platform.

If you choose not to provide us with certain personal information, some features of our Services may not work as intended.

You have the right to opt out of the disclosure of your personal information to third parties who are not acting as our agents. If you do not wish us to share your personal information with such third parties, you may opt out at any time by sending an email to [email protected]. Your choice to opt out will in no way affect the Services we provide to you. We will honor your preferences unless disclosure is required by law or to a third party acting on our behalf under written contract.
